Process Server Solutions: Family Court Matters Resolved

​Legal papers must be served the right way! There are no exceptions to that rule, and when family court matters are involved, there is a lot to take into consideration in order to ensure that the legal documents were properly served and the affidavit correctly executed.

There are many different Family Court Matters – divorce summons and complaints, child support summons and petitions, child support collection enforcement, petitions for visitation. The process server who handles the case must be very knowledgeable about the rules that apply to each case depending on the filing court and the docket (case) letter.

At Associated Services we look at each Family Court case separately before we send it out with the process server. We make sure that we apply the correct rules for service permissible by the court, and in case of court orders signed by a Judge, we carefully follow the instructions stated in the paperwork, adhering to time frames and deadlines.

Here are a couple of Family Court cases we have successfully resolved:
  • Our office was approached by Samantha, a grandmother who was eager to obtain visitation with her young grandchildren. Samantha has not seen them in a few years, and was anxious to get the papers served and proceed with the case. After asking her a number of routine questions about the person to be served and his address, we found out that the address she had may be an old one. We immediately investigated the address and confirmed it was indeed an old one. Our office was able to obtain and confirm a new address prior to sending the paperwork out in the field. The process server was given explicit instructions how to handle the service, and it was successfully completed in due time. We saved Samantha money by not even attempting the old address she had, and were able to complete the service for her. Samantha was tearful and very thankful.
  • Another case involved child support collection enforcement on a non-responsive parent. Associated Services was retained by one of the County Departments of Social Services to serve the paper in another state. We promptly instructed our server in Minnesota how to approach the respondent and gave the timeframe prescribed by the court. The process server was able to confirm the address as a good one on his first attempt. The server made numerous attempts at different times of the day and late in the evening, but the respondent would not come to the door. It was apparent that the person to be served knew about the case and was avoiding service. Our process server was instructed to keep attempting and leaving notices on the door. After a thorough due diligence, the process server completed a very detailed affidavit of due diligence. This allowed the Department of Social Services to request a court order to nail and mail the papers to the door. The case was successfully served and the child support collection enforced.
